Terms of Service & End User License Agreement for Agone

These Terms of Service (“Terms”) are a legal agreement between you and Muhammad Ali Qasim (“Agone”, “we”, “us”, or “our”) governing your use of the Agone mobile application (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using it, you confirm that you meet this requirement and that the information you provide is accurate.

2. The service

Agone provides tools to track fitness, nutrition, habits, goals, finances, and journaling, plus AI-generated coaching, insights, and voice features. The App is for personal, informational, and motivational purposes only.

Agone is a self-improvement and self-tracking platform with gamified elements (such as scores, streaks, and insights) for people who choose to track and improve their own habits and log their own progress. We do not provide professional advice, coaching, guidance, instruction, diagnosis, treatment, or recommendations of any kind, and we make no claims, guarantees, representations, or promises about any results or outcomes (including health, fitness, financial, or personal outcomes). Any text, scores, “coach” messages, suggestions, or insights produced by the App are automated, general, motivational content generated for your personal use only — they are not professional advice and not individualized guidance you should rely on. You are solely responsible for your own choices, actions, and results.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time in Me → Delete account.

4. Acceptable use & zero tolerance for objectionable content

Agone has zero tolerance for objectionable content or abusive users. By using any social or user-generated-content feature (friends, groups, shared activity, or any content visible to others), you agree not to:

• Post, upload, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, hateful, obscene, sexually explicit, or otherwise objectionable.
• Harass, bully, impersonate, threaten, or abuse other users.
• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, hack, or disrupt the App or its servers.
• Attempt to access another user’s account or data.

You can report objectionable content or users, and block abusive users, from within the app. We review reports and may remove content and suspend or terminate accounts that violate these Terms, without notice. There is no tolerance for objectionable content or abusive behavior on Agone.

5. Your content

You retain ownership of the content you create (journal entries, logs, etc.). You grant us a limited license to store, process, and display that content solely to operate the App for you (including syncing and generating AI responses). You are responsible for your content and confirm you have the right to provide it.

6. Health & fitness disclaimer (please read)

Agone is not a medical device and does not provide medical advice. The App, including its AI Coach, insights, workouts, and nutrition features, is for general informational and motivational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified physician or healthcare professional before starting any exercise, nutrition, weight-loss, or wellness program, especially if you are pregnant, have a medical condition, or take medication.
• Never disregard professional medical advice or delay seeking it because of something in the App.
• Physical activity carries inherent risks. You participate at your own risk and assume full responsibility for any injury or harm.
• If you think you may have a medical emergency, call your doctor or emergency services immediately.

7. Nutrition & food data disclaimer

Nutrition values (including barcode lookups via third-party databases) may be inaccurate or incomplete and are estimates only. Do not rely on them for medical, allergy, or dietary decisions.

8. Financial disclaimer

The money features are simple personal tracking tools for amounts you enter manually. Agone is not a financial institution and does not provide financial, investment, tax, or accounting advice. Consult a qualified professional for financial decisions.

9. AI features disclaimer

The AI Coach, insights, and voice features generate responses using third-party AI models. AI output may be inaccurate, incomplete, or inappropriate, and the coach’s direct/blunt motivational tone is a stylistic choice, not professional advice. Do not rely on AI output for medical, financial, legal, or other important decisions. Verify anything important independently.

10. Third-party services

The App relies on third-party services (including Apple, Google/Firebase, Google Gemini, OpenAI, and Open Food Facts). Your use of those features may be subject to the third parties’ own terms, and we are not responsible for their services.

11. Intellectual property

The App, its design, branding, and software are owned by Muhammad Ali Qasim and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal use, subject to these Terms and the Apple App Store terms (Section 15).

12. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA OR AI OUTPUT WILL BE ACCURATE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Muhammad Ali Qasim AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH/PERSONAL INJURY ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD $50. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

14. Indemnification

You agree to indemnify and hold harmless Muhammad Ali Qasim from claims, damages, and expenses arising out of your misuse of the App or violation of these Terms.

15. Apple App Store terms

These Terms are between you and Muhammad Ali Qasim only, not with Apple. Apple is not responsible for the App or its content. To the extent applicable:

• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any product warranties, claims, or third-party intellectual-property claims relating to the App; any product warranty is our responsibility.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You confirm you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list, and you will comply with applicable export laws.

16. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive (e.g., disclaimers, limitation of liability) will survive termination.

17. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide notice in the App. Continued use after changes means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, unless your local consumer law requires otherwise.
